Property easements typically refers to a specific real estate ownership portion. For every parcel of real estate, there are a bundle of rights associated with the ownership. This bundle of rights includes most of the commonly known rights, such as the surface rights, and structures on the property. There may also be easements granted to other parties, to allow access or right to use a portion of the land for a special purpose. It normally does not grant possession or a license. Determining the status of property easements begins with a special type of title search appropriately called an easements search. This specialized title search involves researching the historical ownership of the property, to locate any granting of property easements. This granting of rights normally occurs as a transfer which is not part of a full property ownership transfer. In most cases, the easements do not appear on the current property deed.

 

The granting of easements may not be attached to a property file in the county or municipal records. The document which transfers the easements may be indexed to the name of the person who owned the property at the time the easement was granted
